Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ElevenStack LLC (“ElevenStack,” “we,” “us,” or “our”) websites, applications, and services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.
1. Eligibility and Account Registration
You must be able to form a binding contract to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for activities that occur under your account.
2. Our Services
ElevenStack provides tools for businesses, which may include modules such as forms, bookings, invoicing, payments, marketing, and related business utilities. Features may change over time, and some features may be limited by plan level or configuration requirements.
3. Customer Data and Submitted Content
You may upload, submit, or process data through the Services (“Customer Data”). You retain ownership of your Customer Data. You grant ElevenStack a limited license to host, process, transmit, and display Customer Data solely to provide and improve the Services, prevent abuse, and comply with law.
You represent that you have all rights and permissions needed to provide Customer Data and that your use of the Services will comply with applicable laws (including privacy and consumer protection laws).
4. Acceptable Use
You agree not to:
- Use the Services for unlawful, harmful, fraudulent, or deceptive purposes
- Attempt to access or probe our systems, accounts, or data without authorization
- Transmit malware, spam, or content that infringes intellectual property rights
- Interfere with or disrupt the Services or circumvent security or access controls
- Use the Services to process data in violation of the rights of others
5. Plans, Fees, and Payments
Some features require a paid plan or additional configuration. If you purchase a paid plan, you agree to pay the fees and applicable taxes. Fees are generally non-refundable except where required by law or expressly stated otherwise.
If you enable payment processing or invoicing, you may also be subject to terms of our payment processors or partners. You are responsible for complying with any processor requirements applicable to you.
6. Third-Party Services
The Services may integrate with or link to third-party services (for example, payment processors, analytics, messaging providers, or embedded tools). We do not control third-party services and are not responsible for their content, policies, or practices. Your use of third-party services is governed by their terms.
7. Intellectual Property
ElevenStack and its licensors own the Services, including software, design, and content (excluding Customer Data). You may not copy, modify, distribute, sell, or lease any part of the Services unless permitted by law or authorized in writing by ElevenStack.
8. Beta Features
From time to time, we may offer beta features. Beta features may be incomplete, change without notice, and may have reduced support. Your use of beta features is at your own risk.
9. Disclaimer of Warranties
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, ElevenStack disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the fullest extent permitted by law, ElevenStack will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Services.
To the fullest extent permitted by law, ElevenStack’s total liability for any claim arising out of or related to the Services will not exceed the amounts you paid to ElevenStack for the Services in the three (3) months before the event giving rise to the claim (or $100 if you have not paid anything).
11. Indemnification
You agree to indemnify and hold harmless ElevenStack from and against claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or related to: (a) your use of the Services, (b) your Customer Data, or (c) your violation of these Terms or applicable law.
12. Suspension and Termination
We may suspend or terminate access to the Services if we reasonably believe you violated these Terms, pose a security risk, or if required by law. You may stop using the Services at any time. Upon termination, your right to use the Services ends.
13. Changes to the Services or Terms
We may update the Services and these Terms from time to time. If we make material changes, we will post the updated Terms and update the effective date. Your continued use after changes become effective indicates acceptance.
14. Governing Law and Venue
These Terms are governed by the laws of [Your State/Country], without regard to conflict of law rules. Any disputes will be brought in the courts located in [Your County/State], unless applicable law requires otherwise.
